Terms and Conditions

1. Scope of Application

These General Terms and Conditions govern the legal relationships between LillTschudi.sale (hereinafter “we” or “us”) and our customers (hereinafter “Customer”) for all business in the field of buying and selling Lill Tschudi artwork as well as for related services such as authentication and valuations.

2. Subject Matter and Contract Formation

The subject of our activity is the trade in Lill Tschudi artwork as well as the acquisition of individual works, collections, and artist estates. The artworks presented on our website or in other media do not constitute a legally binding offer, but rather an invitation to contact us (invitatio ad offerendum).

A legally valid purchase or sale contract is concluded exclusively through direct, oral or written agreement between us and the customer, usually after personal inspection of the artwork.

3. Prices and Payment Terms

All prices are individually agreed upon. The agreed purchase price is due immediately upon conclusion of the contract, unless otherwise agreed in writing. Payments can be made in cash or by bank transfer.

Until full payment of the purchase price, the artwork remains the property of LillTschudi.sale (retention of title).

4. Delivery and Transport

Delivery of the artwork takes place after full payment. In principle, the work must be collected by the buyer from us. When we purchase works, collection is individually agreed with the seller.

Other transport or delivery arrangements must be discussed separately and agreed in writing. The risk passes to the customer upon handover of the work to the customer or a transport company commissioned by them.

5. Warranty and Liability (Purchase as Examined)

All Lill Tschudi artworks are sold in the condition they are in at the time of inspection (“purchase as examined”). The customer has the opportunity to thoroughly examine the object before purchase. With the purchase, the customer confirms having examined the work and accepted its condition.

Any warranty for material defects is completely excluded to the extent legally permissible. Excluded from this exclusion are guaranteed characteristics (e.g., authenticity guarantees) as well as liability for damages from grossly negligent or intentional breach of duty.

Information about the works (e.g., regarding artist attribution, technique, age) is provided to the best of our knowledge and belief, but does not constitute a guarantee unless explicitly designated as such.

6. Applicable Law and Jurisdiction

All legal relationships between the customer and LillTschudi.sale are subject exclusively to Swiss law. The UN Convention on Contracts for the International Sale of Goods (CISG) is expressly excluded.

The exclusive place of jurisdiction for all disputes is Zurich, Switzerland.
